HON'BLE SRI JUSTICE A.RAJASHEKAER REDDY TRANSFER C.M.P.NO.654 OF 2015 O R D E R:
This Transfer C.M.P. is filed by the petitioner-wife for transfer of O.P.No.617 of 2012 pending on the file of the Family Court Judge, Visakhapatnam to the court of the Judge, Family Court, Guntur District, which was filed by the respondenthusband for grant of divorce. The facts of the case are that the marriage of the petitioner with the respondent was performed on 06.03.1994 in Police Kalyanamandapam, Guntur District and they were blessed with two male children. When the respondent started harassing the petitioner for additional dowry and abused her in filthy language, the petitioner filed a complaint before Nagarampalem Police Station, Guntur District against the respondent and her in-laws and the same was registered as a case in Cr.No.256/2012 under Section 498-A I.P.C. and at present she is residing at her parents' house along with her children. It is also stated that as there is no male assistance, the petitioner cannot travel along with her children from Guntur District to Visakhapatnam District, to defend her case.
Though notice is served, no counter is filed by the respondent.
In view of the averments made by the petitioner in the affidavit filed in support of the petition stating that the petitioner is having two minor children and living with her parents at Guntur and a criminal case is also pending against respondent at Guntur Court, I deem it proper that F.C.O.P.No.617 of 2012 is liable to be transferred from the file of the Family Court Judge, Visakhapatnam to the court of the Judge, Family Court, Guntur. Accordingly, Transfer C.M.P. is allowed. Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
