THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.23523 OF 2016 ORDER:

The case of the petitioner is that he was assigned land to an extent of Acs.5.00 in Survey No.337/1A situated at Chindepalli of Yerpedu Mandal, Chittoor District, under Ex-servicemen Quota vide DKT No.126/4/1406, dated 30.06.1997. He submits that after expiry of ten years period, he intended to alienate the said property and obtained 'No Objection Certificate' (NOC) from the 3rd respondent and presented the document before the 4th respondent for registration. However, the 4th respondent refused to entertain the document for registration and insisting on production of fresh NOC, though he already obtained the same. The petitioner further submits that this Court in similar circumstances in W.P.M.P.No.10609 of 2016 in W.P.No.8374 of 2016, dated 15.03.2016, directed the Sub Registrar to entertain the document presented for registration without insisting on production of NOC and to release the same.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue appearing for the respondents. Learned Assistant Government Pleader submits that the Government has issued G.O.Ms.No.279, dated 04.07.2016, dispensing with the grant of NOC in case of assignment of land to Ex-servicemen and Freedom Fighters, where ten years period has elapsed from the date of assignment.

In view of the same, the Writ Petition is disposed of directing the 4th respondent to receive and register the document presented by the petitioner for registration by taking into account the G.O.Ms.No.279, dated 04.07.2016, and also the order, dated 15.03.2016, passed in W.P.M.P.No.10609 of 2016 in W.P.No.8374 of 2016, in accordance

with the Rules framed under the Registration Act, 1908, if the same is otherwise in order. There shall be no order as to costs. As a sequel, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
