This appeal is filed under Order XLIII Rules 1 and 2 of C.P.C. assailing the order dated 09.03.2012 passed in I.A.No.473 of 2010 in F.D.I.A.No.953 of 2008 in O.S.No.5 of 2002 on the file of the I Additional District Judge, Vizianagaram.

Learned counsel for the appellants seeks permission of this Court to permit the appellants to withdraw the appeal with a liberty to avail the remedies available to them under law. Permission is granted.

Accordingly, the Civil Miscellaneous Appeal is dismissed as withdrawn granting liberty as prayed for. There shall be no order as to costs. Consequently, Miscellaneous Petitions, if any, pending in this Appeal shall stand closed.
