THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 26178 of 2016 O R D E R:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue (Andhra Pradesh) on behalf of the respondents. The grievance of the petitioner in this Writ Petition is that though he has presented a document in respect of the land admeasuring Ac.5-00 cents, situated in Sy.Nos.107/1, 107/2, 107/3 of Thummalacheruvu Village, Kanaganapalli Mandal, Anantapuramu District, for registration, 5th Respondent-Sub-Registrar, Anantapuramu has not received the same. The learned Government Pleader is fair enough to submit that 5th Respondent will receive the document submitted by the petitioner and if he is not inclined to register the said document, he will pass an order under Section 71 of the Registration Act, 1908 (in short "the Act") and communicate the same to the petitioner.
In view of the said submission, Respondent No.5 is directed to receive the document presented by the petitioner and consider the same for registration. In case, Respondent No.5 is not inclined to register it, he shall pass a reasoned order under Section 71 of the Act within four weeks from the date of submission of the document and communicate the same to the petitioner.
The Writ Petition stands disposed of with this order. No costs. Consequently, the Miscellaneous Applications, if any shall also stand disposed of.
