HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CIVIL REVISION PETITION Nos.4462, 4419, 4434 & COMMON ORDER:

Heard learned counsel for the petitioner/plaintiff before admission and before ordering notice to other parties to the suit in OS.No.144 of 2015 before the learned IV Additional District Judge, Nellore.

The suit originally filed as OS.No.337 of 2012 for the reliefs of declaration of plaintiff as absolute owner and vacant possession of items Nos.1 & 2 of plaint A schedule property and to direct the defendants 12 to 14 not to recognize sale deed 12.02.2004 standing in the name of defendant Nos.1 & 2 in relation thereto for any purpose and to direct defendant Nos.1 & 2 to pay damages for use and occupation and for costs.

The suit is later transferred to the file of IV Additional District Judge, Nellore and renumbered as OS.No.144 of 2015 as it is a suit of 2012 and had been continued with the original number from the say that it could have been one of the identified matters in presenting for early disposal that is deprived, thereby in seeking to direct the trial Court for early disposal of the suit.

The suit is stated at the arguments stage from closure of the evidence of both sides.

Accordingly and in the result, CRP.No.4462 of 2018 is disposed of by directing the lower Court to decide the suit on merits within three (3) months from the date of receipt of this order. Needless to say all MPs including any application for violation of the injunction order pending shall be disposed of along with suit at least.

Having regard to the above, CRP.Nos.4419, 4434 & 4449 of 2018 are closed for no more orders required therein. Miscellaneous petitions, if any, shall stand closed. _______________________________ Dr. B. SIVA SANKARA RAO, J Date: 03.08.2018 ska
