THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.11037 of 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.1 in Crime.No.463 of 2023 on the file of Ameenpur Police Station, Sangareddy District, registered for the offences under Sections 366 and 376 (2) of IPC and Sections 5 and 6 of POCSO (Amendment) Act, 2019.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case against the petitioner is that this petitioner and the victim girl eloped on 14.09.2023. They were traced on 17.09.2023 and were remanded to judicial custody on 18.09.2023.

Learned counsel appearing for the petitioner would submit that the victim girl is more than 18 years, however, they have shown her as less than 18 years. Admittedly, even
according to the complaint, they have voluntarily gone and after being traced, the complaint was filed against this petitioner. 5.
On instructions, learned Additional Public Prosecutor would submit that major part of the investigation is complete and only filing of charge sheet is due.

Keeping in view that investigation is complete and all the witnesses were examined, this Court deems it appropriate to grant the relief of regular bail, subject to following conditions:- i) The petitioner/Accused No.1 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties, for a like sum each to the satisfaction of the Judicial First Class Magistrate, Sangareddy District.
ii) The petitioner/Accused No.1 after release shall appear before the concerned Station House Officer on every Monday at 10:00 a.m. for a period of four weeks for the purpose of investigation and thereafter, as and when required.
(iii) The petitioner/Accused No.1 in any manner shall not try to contact either the victim girl or her relatives. Failing which, the Police are at liberty to seek cancellation of bail granted.
iv) The petitioner/Accused No.1 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
