THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.12274 of 2025 ORAL ORDER:

This Criminal Petition is filed before this Court for grant of pre-arrest bail to the petitioners who are apprehending their arrest though their names are not mentioned in Crime No.47 of 2025 registered before the Pulkal Police Station, Sangareddy District, for the offence punishable under Sections 121(2), 352 and 3(5) of BNS. 2.

The case of the prosecution is that on March 28, 2025, at 7:20 am, the complainant - TSRTC driver Dasari Baindla Hanmaiah was driving bus No.TS 15Z 0254 from Sangareddy to Medak when a village dog accidentally hit the front part of the bus near Fasalwadi. Shortly after, a group of six individuals allegedly assaulted the driver, dragging him from his seat and hitting him on the jaw, heart, and above the eye, causing severe bleeding. The complainant lodged a complaint at 11:30 am, requesting necessary action against the accused for obstruction and causing injury. As the father of these petitioners was implicated in this case as

accused, the petitioners are apprehending their arrest, though not arrayed as accused.

Heard Sri N.Manohar, learned counsel for petitioners, and Sri D. Arun Kumar, learned Additional Public Prosecutor, appearing for respondent - State. 4.

Learned counsel for the petitioner submitted that the petitioners are innocent and are no way connected to the offence as alleged. He contended that as the father of petitioners was implicated in crime, the petitioners are apprehending their arrest, though they are not arrayed as accused. Therefore, prayed this Court to allow the criminal petition, granting the relief of anticipatory bail to the petitioners.

On the other hand, learned Additional Public Prosecutor vehemently opposed the submissions made by learned counsel for petitioners stating that there are serious allegations in the complaint which require investigation. Therefore, he prayed the Court to dismiss the Criminal Petition.

Having regard to the rival submissions made and on going through the material placed on record, it is noted that the limited grievance of petitioners is that though their names are not mentioned in the FIR., they apprehend their arrest as their father is arrayed as accused. Considering the facts and circumstances of this case, this Court grants pre-arrest bail to the petitioners, in the event of their arrest, subject to compliance of the following conditions: i.

The petitioners shall surrender before the Station House Officer, Pulkal Police Station, Sangareddy District, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on them executing a personal bond for Rs.25,000/- with two sureties, for the like sum each.

ii.

The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioners shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
