HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Criminal Petition No.8079 OF 2018 ORDER:

The petitioner is the sole accused in Crime No.90 of 2018 on the file of Dichpally Police Station, Nizamabad District. The crime is registered on 11.07.2018 for the offences punishable under Sections 468, 471, 419 & 420 IPC from the report of the Reserve Inspector, 7th Battalion, TSSP, Dischpally as the de facto complainant of stating his signature is forged and fabricated in the pay slip of Sri L.Ramulu, Police Constable (No.1012), the petitioner, and the two constables stood as sureties by names T.Yadavarao (PC 507), K.Shankar (HC 1356) and the Assistant Manager, S.B.I, Pragathi Bhavan Branch, Nizamabad, approached him about the verification of the genuineness of the salary slips of those persons and it is found that the signatures and seal etc are forged and fabricated.

A perusal of the record shows that there is a prima facie accusation and thereby, the petitioner is not entitled to the concession of anticipatory bail, but for to say none of the offences are punishable above seven years, the Station House Officer, Dichpally Police Station is directed to follow the procedure laid down under Section 41-A Cr.P.C. Accordingly, this Criminal Petition is disposed of rather than dismissal.
