HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE A.SHANKAR NARAYANA WRIT PETITION Nos.14897 and 21540 of 2008 COMMON ORDER : (per Hon'ble Sri Justice V. Ramasubramanian) While challenge in the first writ petition being W.P.No.14897 of 2008 is by persons carrying on the business of Real Estate promotion, seeking a declaration that the policy of the Government pronounced in G.O.Ms.No.288, dated 03.04.2008, imposing certain restrictions on the promotion of layouts was illegal;

the second writ petition being W.P.No.21540 of is filed by non-Governmental Organisations challenging two subsequent Government orders vide G.O.Ms.Nos.526 and 527, both dated 31.07.2008, by which the previous policy was changed.

2. In simple terms, the petitioners in both the writ petitions represent conflicting interests.

3. It is admitted today that the original policy, as enunciated in G.O.Ms.No.288, dated 03.04.2008, and the amended policy, as enunciated in G.O.Ms.Nos.526 and 527, both dated 31.07.2008, have both been completely revamped by the present Government after the bifurcation of the State. Therefore, nothing survives for adjudication in both the writ petitions and they are dismissed as having become infructuous in the light of the new policy of the Government. If either of the

parties is aggrieved by the new policy, they will have to workout their remedies in accordance with law, independently. There shall be no order as to costs.

4. As a sequel, miscellaneous petitions pending, if any, in these writ petitions shall stand closed.
