HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION NO. 6606 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief: "to issue an appropriate writ or direction, particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in not considering the case for compassionate appointment on the ground that the application was submitted beyond five years from the date of death of the deceased workman as illegal, unjust, arbitrary, discriminatory, in violation of Art.14 & 21 of the Constitution of India and also contrary to the orders of this Hon'ble Court in W.P.No. 4066/2005 dated 11.6.2010 and consequently the petitioner pray this Hon'ble Court may be pleased to direct the respondents to provide employment to the petitioner herein to the post of Shramik/Conductor on compassionate grounds on par with the persons who were interviewed and selected along with the petitioner in 2013 in the interest of justice and fair play."

2. Heard Sri K. Srinivas Rao, learned counsel for the petitioner and Sri B. Mayur Reddy, learned Standing Counsel for TSRTC.

3. The material produced before this court discloses that the petitioner herein submitted a representation on 28.12.2015 to the Regional Manager, TSRTC, Mahaboobnagar and no orders on the same have been communicated so far.

4. Having regard to the nature of controversy, this Court is of the opinion that ends of justice would be met if the second respondent is directed to take appropriate action on the representation dated 28.12.2015 said to have been submitted by the petitioner herein.

5. In view of the same, the Writ Petition is disposed of directing the second respondent herein to pass appropriate orders on the representation dated 28.12.2015 within a period of one months from the date of receipt of a copy of this order. There shall be no order as to cots.
