THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.8134 OF 2018 ORDER:
This petition is filed under Section 482 Cr.P.C., to quash the proceedings in C.C.No.358 of 2018 on the file of the Chief Metropolitan Magistrate, Nampally at Hyderabad, for the offences punishable under Sections 420 and 506 of IPC against the petitioner, on various grounds.

During hearing, learned counsel for the petitioner requested this Court to dispense with the appearance of the petitioner on the dates of adjournment, except on the date when his personal appearance is required. But, this Court cannot grant such relief exercising power under Section 205 Cr.P.C. and the Magistrate is competent to exercise such power under Section 205 Cr.P.C and pass appropriate order taking into consideration the facts and circumstances and gravity of offence. 3.
In view of the request made by the learned counsel for the petitioner, without touching the merits of the case, I deem it appropriate to permit the petitioner to file appropriate petition under Section 205 Cr.P.C before the Chief Metropolitan Magistrate at Hyderabad, to dispense with his appearance and, on filing such petition, the Chief Metropolitan Magistrate is directed to pass appropriate orders in accordance with law, within a week from the date of filing of such petition.

With the above direction, the Criminal Petition is disposed of without touching the merits of the case. As a sequel, miscellaneous petitions, if any pending, shall stand closed.
