HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.126 of 2015 ORDER:
This petition is filed to withdraw F.C.O.P.No.583 of 2014 from the file of Additional Family Court, City Civil Court, Hyderabad and transfer the same to Family Court, Guntur to be tried along with F.C.O.P. No.52 of 2015 in accordance with law.
2 . Petitioner herein is wife and she filed her affidavit in support of transfer petition, according to which, her marriage with respondent was performed on 10.08.2009 at Hyderabad, during wedlock, they are blessed with son. She stated that she was harassed at the matrimonial house and she was necked out from the house for not fulfilling illegal demands and since then she is living at her parents' house in Guntur. She stated that respondent filed Family Court O.P. for restitution of conjugal rights with false and baseless allegations and that the same is pending for counter. She stated that her son is studying UKG at Bhashyam Blooms, Guntur and her parents are meeting the education expenses of her son.
She stated that every time she is facing difficulty and hardship to travel all the way from Guntur to Hyderabad by leaving her son alone with her aged parents. She further stated that she filed F.C.O.P.No.52 of 2015 for maintenance for herself and her son and she has no male assistance to accompany her from Guntur to Hyderabad. For these reasons, she prayed for transfer of F.C.O.P.No.583 of 2014 from Additional Family Court, Hyderabad to Family Court, Guntur.
3. Respondent in spite of service of notice neither appeared in person nor through any advocate.
4. Heard advocate for petitioner.
5. Considering the reasons stated in the affidavit and also considering the convenience of wife, and also considering the fact that O.P. filed by
husband and O.P. filed by wife have to be tried by one Court, F.C.O.P.No.583 of 2014 is withdrawn from Additional Family Court, City Civil Court, Hyderabad and transferred to Family court, Guntur to be tried along with F.C.O.P.No.52 of 2015 in accordance with law.
6. Accordingly, the Transfer Civil Miscellaneous Petition is ordered. No costs. Miscellaneous Petitions, if any pending, in this petition, shall stand closed.
