THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.26967 OF 2018 Dated:02.08.2018 Between:

Smt. N. Sakuntala, W/o. N. Ramanjaneyulu, Aged 32 years, Occ: Asha Worker, R/o. Kamathampalli Village, Gandlapenta Mandal, Anantapur District .. Petitioner And The State of Andhra Pradesh, rep., by its Principal Secretary, Medical & Health Department, secretariat, Velagapudi, Amaravathi, Guntur and others .. Respondents The Court made the following:

THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.26967 OF 2018 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Medical and Health appearing for respondents 1 to 3.

2.

Petitioner was appointed as Asha Worker in Primary Health Center, Kamathampally Sub-Center, Gandlapenta Mandal, Anantapur District. She apprehends that the 4th respondent, who earlier worked as Asha worker; abandoned the service after 01.03.2014 and in whose place petitioner is appointed, is making efforts to get back into the said post by dislodging the petitioner and in such an event, grave prejudice would be caused to the petitioner.

3.

However, as seen from the pleadings in the Writ Petition, as of now no decision is taken in favour of the 4th respondent and it is only at the stage of consideration of the representation stated to have been made by the 4th respondent. Thus, there is no adverse decision made as on today warranting the petitioner to institute this Writ Petition. The Writ petition is premature. 4.

The Writ Petition is accordingly dismissed leaving it open to the petitioner to work out her remedies as and when cause of action arises. No costs. Miscellaneous Petitions, if any, filed in this Writ Petition shall stand closed.
