THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CIVIL REVISION PETITION No. 4451 of 2016 ORDER :

Heard the learned counsel for the petitioners. 2.

The petitioners are defendants in Original Suit No.771 of 2014 on the file of the Principal Senior Civil Judge, Tirupathi, filed by the respondent herein seeking eviction of the petitioners from the suit schedule property. The trial Court decreed the suit vide judgment and decree dated 01.06.2016 granting one month time to the petitioners to vacate the suit schedule property. Aggrieved by the same, the petitioners preferred Appeal Suit No.94 of 2016 on the file of the V Additional District Judge, Tirupathi and also filed I.A. No.414 of 2016 seeking stay of the operation of the judgment and decree of the trial Court pending disposal of the Appeal. Grievance of the petitioners is that though the said application was made on 29.07.2016, no orders are being passed in the said application till date by the appellate Court. It is urged that the respondent filed Execution Petition No.48 of 2016 for eviction of the petitioners and the same is causing serious hardship to them.

Though various grounds are urged, learned counsel for the petitioners seeks a direction to the appellate court to pass appropriate orders in I.A. No.414 of 2016 in A.S. No.94 of 2016 at an early date. 4.

Having regard to the circumstances of the case, the learned V Additional District Judge, Tirupathi is directed to pass appropriate orders in accordance with law in I.A. No.414 of 2016 in A.S. No.94 of 2016 as early as possible preferably within a period of three (3) weeks from today. Since no order adverse to the interest of the respondent is being passed in this revision, no notice is required to him.

The Civil Revision Petition is disposed of with the aforesaid direction. No costs. Pending miscellaneous petitions in this revision shall stand closed.
