HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.28166 of 2015 ORDER:

Heard.

The petitioner alleges inaction on the part of the 3rd respondent in issuing pattadar pass books and title deeds sought for by her in respect of the land admeasuring Ac.1-00 cents in R.S.No.472/3 situated at Nidamarru Village, Krithivennu Mandal, Krishna District, which the petitioner claims to have purchased under a registered Sale Deed bearing Document No.1655/2012. The petitioner's request is stated to be pending since 05-112014 and a legal notice was also issued by the petitioner's lawyer to the 3rd respondent on 28-06-2015. The present writ petition is, therefore, filed alleging inaction.

Learned Government Pleader has received instructions from the 3rd respondent, which state that there is a dispute, as the vendor of the petitioner appears to have sold the land in question earlier to another person under an agreement, dated 23-11-2009 and the petitioner appears to be not in possession and because of the said civil dispute, the 3rd respondent could not consider the petitioner's application.

It is evident that the petitioner's application is pending since 05-112014 and no orders are passed by the 3rd respondent so far. Hence, the writ petition is disposed of directing the 3rd respondent to consider the petitioner's request in accordance with law and pass appropriate orders expeditiously, preferably within four weeks from the date of receipt of a copy of this order. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
