A.S.M.P.No.2700 of 2014 and APPEAL SUIT No.564 of 2009 COMMON ORDER:

A.S.No.564 of 2009 arises out of order, dated 11.08.2009 in E.A.No.257 of 2008 in E.P.No.71 of 2007 in O.S.No.534 of 2002 on the file of the learned I Additional Senior Civil Judge, Guntur. The appellant filed AS.MP.No.2700 of 2014 to permit him to withdraw the appeal.

In his affidavit filed in support of AS.MP.No.2700 of 2014, the appellant has averred that after demise of his father, he has cleared the dues and that a memo filed to that effect was taken on record by the lower Court and E.P.No.71 of 2007 was terminated by it. In view of the same, the appellant sought for withdrawal of the appeal. Accordingly, AS.MP.No.2700 of is allowed and A.S.No.564 of 2009 is dismissed as withdrawn. As a sequel to dismissal of appeal as withdrawn, interim order, dated 22.09.2009 is vacated and AS.MP.No.1732 of 2009 is dismissed.
