HON'BLE SRI JUSTICE S. RAVI KUMAR WRIT PETITION No.19564 of 2003 ORDER:

This writ petition is filed to declare the action of respondents in changing the service conditions of petitioner consequent to transfer from KK-I CSP, Mandamarri Area to Bhoopalpally Area as illegal, arbitrary and direct respondents to utilize the services of petitioner as General Mazdoor (Surface) at Bhoopalpally area or at any other place and to pass appropriate orders.

2. Writ petitioner herein was appointed in Singareni Collieries Company in the year 1988 as Badli Filler and subsequently absorbed as Coal Filler in 1992 thereafter he was appointed as General Mazdoor (Surface) as per office order dated 25.09.1997 in Category-I wages. After appointment as General Mazdoor (Surface) his services were utilized at Area Stores, Mandamarri and subsequently transferred to Coal Screening Plant (C.S.P.) KK.1 (CSP), Mandamarri area. It is the contention of petitioner that he has been relieved in pursuance of the said order and he reported to the Project Officer, Bhoopalpally, who issued office order dated 10.06.2003 allotting KTK 5 and 5-A Inclines Mines to him and mentioned him as General Mazdoor in spite of his appointment as General Mazdoor (Surface). According to petitioner, he orally informed the Project Officer that his services have been utilized in Surface, but his request

was not considered, therefore, the direction of the Project Officer, Bhoopalpally, through office order dated 10.06.2003 is illegal, arbitrary and liable to be set aside.

Advocate for petitioner submitted that this Court granted interim direction on 17.09.2003 in W.P.M.P.No.24535 of 2003 directing respondents to continue the services of petitioner as General Mazdoor (Surface) and the same has been complied with, therefore, in view of that interim direction, no further orders are necessary.

4. Considering the submission of advocate for petitioner, this writ petition is disposed of in terms of interim order dated 17.09.2003.

5. Miscellaneous petitions pending, if any, shall stand closed. No costs.
