Heard learned counsel for the parties.
The petitioners were admittedly given notices under Section 9 (3) and 10 of the Land Acquisition Act with regard to their lands acquired. The petitioners state that they appeared before the Land Acquisition Officer and submitted detailed objections, dated 3.7.2015. The grievance of the petitioners is that the Land Acquisition
Officer, without considering the said objections, is contemplating to decide the compensation amount. Learned Government Pleader for Land Acquisition, on instructions, submits that the Land Acquisition Officer will take into consideration the provisions of Section 26 of the Land Acquisition Act 30 of 2013 and determine the compensation.
In view of that, I see no reason in the apprehension of the petitioner. Since the petitioners have already appeared and filed their objections before the third respondent, the writ petition is disposed of directing the third respondent who is conducting the enquiry, to consider the petitioners' objections, referred to above and pass appropriate orders determining the compensation amount in accordance with law.
Miscellaneous applications, if any, shall stand closed. No order as to costs.
