HON'BLE SMT. JUSTICE LALITHA KANNEGANTI CRIMINAL PETITION No.10143 of 2021 O R D E R:
This Criminal Petition under Section 438 Cr.P.C. is filed by petitioner - Accused in connection with Crime No.782 of 2021 of Chilakalaguda Police Station, registered for the offences punishable under Sections 419, 420, 468, 471, 506 and 474 of IPC, seeking pre-arrest bail.

A report was lodged by the de facto complainant stating that when he approached the Corporation Bank, MG Road Branch for housing loan, the bank officials refused to sanction loan on the premise that his SIBIL score is less. It is stated that petitioner by using the PAN car of complainant obtained credit cards and also had taken loans in the name of complainant. It is further alleged that petitioner has obtained job in postal department by using PAN card of de facto complainant. When the complainant questioned the petitioner, he beat the complainant. Basing on the said report, the present crime was registered.

Heard Sri K.Rohit, learned counsel for petitioner and learned Assistant Public Prosecutor appearing on behalf of respondent-State.

Learned counsel for petitioner submits that petitioner is alleged to have committed the offences punishable under Sections 419, 420, 468, 471, 506 and 474 of IPC. He submits that petitioner and de facto complainant are cousins and their
names are also same i.e. R.Mallesh and as per the complainant, petitioner impersonated him and obtained job in postal department. He submits that not only against the petitioner, but against the other family members, the complainant has filed cases. Along with the petition, he filed Aadhar card and other material to show that petitioner's name is R.Mallesh. He submits that petitioner has been implicated in this case, as such his case may be considered for grant of pre-arrest bail. 5.
Per contra, learned Assistant Public Prosecutor submits that there are allegations against the petitioner and investigation is pending, so far one witness was examined and at this stage, petitioner is not entitled for pre-arrest bail. 6.
Taking into consideration the relationship between the parties, this Court deems it appropriate to grant pre-arrest bail to the petitioner.

In the result, criminal petition is allowed and the petitioner / Accused shall be enlarged on bail in the event of his arrest in connection with Crime No.782 of of Chilakalaguda Police Station on his executing a bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties each for a like sum to the satisfaction of Station House Officer, Chilakalaguda Police Station.
