THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.12276 of 2025 Seeking the Court to enlarge the petitioner who is arrayed as accused No.7 in FIR.No.231 of 2024 of Gummadidala Police Station, Sangareddy District, on bail, the present Criminal Petition is filed. 2.

The brief facts of the case are that, on 31.12.2024, the Sub-Inspector of Police conducted a raid and seized prohibited drugs from the possession of the accused and on the confession statement of accused Nos.1 to 4, the petitioner herein was implicated as accused No.7 and the said prohibited substance used for manufacturing of adulteration of toddy. Based on the said complaint, the Police registered FIR No.231 of 2024 for the alleged offences under Sections 8 (c) r/w 22(c) and 29 of NDPS Act, 1985.

Heard Sri S. Sudarshan, learned counsel appearing on behalf of the petitioner as well as Sri Arun Kumar

Doddla, learned Additional Public Prosecutor for respondent-State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the alleged offences and the petitioner herein was arrested on 21.08.2025 by executing P T warrant and in connection with other crime he was arrested on 23.09.2025 and executed P T Warrant on 17.03.2025. It is further submitted that all other accused were already granted bail. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations leveled against the petitioner are serious in nature. It is further submitted that the petitioner herein is involved in two other crimes also and he is a habitual offender and if he is released on bail, again he will involve in the same crime. Further, the investigation is not yet completed.

Therefore, he prayed the Court to dismiss the criminal petition.

In light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner herein is in jail from 21.08.2025 and all the other accused were already granted bail. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions. i.

The petitioner/accused No.7 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned JFCMCum-Special Mobile Court, at Sangareddy, Sangareddy District.

ii.

The petitioner/accused No.7 shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner/ accused No.7 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.

(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
