THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.32517 OF 2014 ORDER:
No representation is made on behalf of the petitioner. Heard the learned counsel for the respondents. This Writ Petition is filed to declare the action of respondent Nos.1 and 2 in not appointing the petitioner as Assistant General Manager (Legal) and in not filling up three vacancies as per the advertisement in the category of OBC and sought for a consequential direction to appoint the petitioner as Assistant General Manger (Legal).
By order dated 30.10.2014 made in WP.MP.No.40654 of 2014, this Court directed respondent Nos.1 and 2 to consider the representation of the petitioner dated 15.02.2013 within a period of six weeks from the date of receipt of a copy of that order. Along with counter affidavit filed on behalf of the respondents, the order dated 30.12.2014 is enclosed. A reading of the order dated 30.12.2014 discloses that on consideration of claim of the petitioner and the directions issued by this Court on 30.10.2014, the petitioner was informed that he is not eligible and cannot be appointed as Assistant General Manager (Legal). The prayer in the Writ Petition was to appoint the petitioner as Assistant General Manager (Legal), which claim has been considered and rejected by the second respondent by the order dated 30.12.2014. Thus, the cause in the Writ Petition does not survive and it is, accordingly, dismissed. It is, however, open to the petitioner to avail remedies as available in law, if aggrieved by the order dated 30.12.2014 and if so advised. There shall be no
order as to costs. Miscellaneous petitions, if any, pending shall stand dismissed.
