This Criminal Petition is filed by the petitioner-Accused No.2 under Section 438 Cr.P.C. seeking to grant anticipatory bail to him in Crime No.396 of 2015 on the file of Ramachandrapuram Police Station, Cyberabad, registered for the offence punishable under Section 302 r/w 34 IPC.

Heard and perused the material available on record. The petitioner is arrayed as accused No.2. It is the case of the prosecution that the petitioner asked the wife of the deceased to send her husband to the house of one Srinivasa Goud-A1 and the deceased went there and did not return. Leaned Counsel for the petitioner submitted that no specific overt acts were attributed against the petitioner.

Considering the facts and circumstances of the case, this Court is of the view that the custodial interrogation is necessary in this case. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.
