HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO Writ Petition No.9212 of 2013 Order:

This Writ Petition is filed challenging the inaction of the respondents in considering and disposing of the representation dated 29.08.2012. A reading of the representation shows that one V. Tirupathi Rao who worked in the defence was assigned the land of an extent of Ac.5.16 cents in various survey numbers situated at Pippara village, Ganapavaram Mandal, West Godavari District and later on he died. It was further alleged that the said land was being occupied by some third parties and the writ petitioners sought for enquiry.

Now a counter affidavit is filed stating that the third respondent enquired into the matter and there is no truth in the representation put in by the petitioners and it is entirely false as the land covered by Survey Nos.487, 489 and 492, admeasuring Ac.1-24 cents, Ac.1-75 cents and Ac.2-17 cents respectively of Pippara village, Ganapavaram Mandal was classified in the village accounts as "Government Poramboke/Murugu Kaluva", but not a zeryothi land and the same was never assigned and not allotted to anyone including the petitioners grand father under Ex-Serviceman quota and thus the petitioners have no title or right over the land in question. Learned counsel for the petitioners relied on an endorsement made by the then Collector on 31.08.1995 forwarding the representation of the petitioners for assignment of the land. But, such an endorsement will not confer any title in favour of the petitioners and in view of the categorical assertion made in the counter affidavit no relief can be granted to the petitioners.

The Writ Petition is, accordingly, dismissed. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition shall stand closed.
