The present Writ Petition came to be filed seeking issuance of writ of mandamus declaring the inaction of the third respondent in considering the petitioner for appointment to the post of Staff Assistants, pursuant to the notification dated 04.09.2011, as illegal and arbitrary.

A notification came to be issued by the third respondent-Bank for selection of 92 candidates. Out of 92 candidates, 23 posts were reserved for departmental in-service candidates, while the remaining posts were reserved for direct recruitment. The petitioner is an in-service candidate. It is the case of the petitioner that though there are vacancies, the third respondent-bank has not considered the case of the petitioner for appointment as Staff Assistant. 4.

The material on record would show that the petitioner submitted his representation on 14.11.2013, to consider his case for appointment as Staff Assistant in the existing vacancies in D.C.C.Bank Ltd., East Godavari District at Kakinada. 5.

Learned counsel for the petitioner placed on record the order passed by this Court in W.P.No.30715 of 2013, wherein under the same notification dated 04.09.2011 and in similar circumstances, the case of the petitioners therein was considered and the respondent-Bank therein was directed to consider the representation made by the petitioners therein.

Having regard to the above, the writ petition is disposed of directing the third respondent to dispose of the representation made by the petitioner, if not already done, in accordance with law, as early as possible, preferably within a period of two

months from the date of receipt of a copy of the order. There shall be no order as to costs.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
