THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.11382 of 2015 ORDER:
1. This writ petition is filed seeking a direction to the 2nd respondent to dispose of the representations made by the petitioner on 16.8.2014 and 19.8.2014.
2. It is stated that the petitioner had been working as Archaka for the past 14 years in Sri Lakshmi Narayana Swamy Vari Temple, Veeravally Agraharam, Madugula Mandal, Visakhapatnam District. While so, he was not allowed to discharge his duties with effect from 26.7.2014 by the 3rd respondent, who is a founder trustee. Aggrieved by the same, the petitioner submitted representations on 16.8.2014 and 19.8.2014 to the 2nd respondent-Assistant Commissioner of Endowments, Visakhapatnam. But the 2nd respondent has not passed any orders so far. Hence, the petitioner approached this Court.
3. During the course of arguments, the learned Counsel for the petitioner submitted that against the termination of the petitioner, there is a remedy of appeal under the provisions of the A.P. Charitable and Hindu Religious Institutions and Endowments Act, and therefore, the petitioner may be permitted to prefer an appeal before the appropriate authority.
4. Considering the above submission and the facts and circumstances of the case, the Writ Petition is disposed of with the following direction: "The petitioner is directed to prefer an appeal against his removal before the competent authority, within a period of 15 days from the date of receipt of a copy of this order. On such appeal being filed, the appellate authority concerned is directed to dispose of the same as expeditiously as possible."
No order as to costs. Consequently, the miscellaneous petitions pending, if any, shall stand closed.
