THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.26913 of 2018 ORDER:
Heard Mr.Akkam Eshwar for petitioners and the learned Assistant Government Pleader (Revenue) for respondents 1 to 3.
The petitioners pray for the following relief: ".........Writ of Mandamus to declare the action of the 3rd respondent and his subordinates in interfering with the peaceful possession and enjoyment of the property to an extent of Ac.3.90 cents in Sy No.11/5 situated at Anambattu Village, Thorur Post, Puttur Mandal, Chittoor District belongs to the petitioners as illegal, arbitrary and in violation of principles of natural justice and again the settle principles of law apart from violation of the provisions of the A.P.Assigned Lands (Prohibition of Transfer) Act 1977 and consequently direct the respondents not to interfere with the peaceful possession and enjoyment of the petitioner over the subjet property........."
On 01.08.2018, at the request of respondents, the writ petition was adjourned for instructions.
The Assistant Government Pleader places on record, the written instructions dated 01.08.2018 received from 3rd respondent. The instructions are accepted.
The Assistant Government Pleader further submits that the revenue officials never interfered with the possession and enjoyment of the petitioners and during enquiry, it is revealed that the 4th respondent is interfering with the possession of the petitioners with the contention that the subject land is wrongly classified as "Annadeenam" in the revenue records.
He further states that petitioners are having legal title under DKT patta over the scheduled land as per the revenue records.
The statement is placed on record and accepted. Writ petition is disposed of accordingly. No order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed.
