THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35383 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India by the petitioner seeking to issue a writ of Mandamus, to declare the action of the respondent in not receiving the application of the petitioner for correction of the entry of date of birth in the passport No.K6410934 of the petitioner, as illegal and arbitrary and consequently, direct the respondent to carryout rectification/ correction of the incorrect date of birth in the passport of the petitioner. Heard and perused the material available on record. The grievance of the petitioner is that the year in her date of birth in her passport was wrongly mentioned and therefore, she filed an application before the respondent for rectification/ correction of the said mistake.

But, the respondent is not receiving the said application on the premise that such applications are not entertained. Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on the merits of the case, the respondent is directed to receive the application submitted by the petitioner and dispose of the same in accordance with law.

With the above direction, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
