HON'BLE SRI JUSTI CE P. KESHAVA RAO W RI T PETI TI ON No.2 3 2 7 8 of 2 0 1 4 ORDER:

Heard the learned counsel for the petitioners as well as the learned Government Pleader appearing for the respondents 1 to 3. 2.

The prayer sought in the writ petition is as under: "... this Hon'ble Court may be pleased to issue an appropriate order or direction, more particularly, one in the nature of a writ of mandamus declaring the action of the respondents No.2 and 3 in interfering with the private civil disputes of the petitioners with the 4th Respondent as illegal, arbitrary, high-handed, violative of Article 14 and Article 21 of Constitution of India and consequently direct the respondents No.2 and 3 not to interfere with the civil disputes of the petitioner with 3rd parties, and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstance of the case." 3.

The learned Government Pleader, appearing for respondents 1 to 3, brought to the notice of this Court that the petitioners approached the third respondent on 15.07.2014 and lodged a complaint against the respondent No.4. Pursuant to the said complaint, an entry was made in the General Diary of the station and enquiry was taken up. During the course of the enquiry, it was revealed that there are civil disputes between the petitioners and the respondent No.4. Therefore, the respondent No.3 advised the parties to approach a competent civil Court for redressal. In those circumstances, no crime was registered, except making an entry in the GD as stated supra. Learned Government Pleader has also brought to the notice of this Court that they have never interfered with the civil disputes between the petitioners and the respondent No.4 4.

In these circumstances, this Court is of the opinion that there are no merits in the writ petition and the same is liable to be dismissed.

Accordingly, the writ petition is dismissed. As a sequel thereto, pending miscellaneous petitions, if any, shall stand dismissed. There shall be no order as to costs.
