THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.27662 OF 2015 ORDER:
This writ petition is filed under Article 226 of the Constitution of India for the following relief:
"to issue writ or order or directions especially one in the nature of writ of Mandamus declaring the action of Respondents that without registering any case simply disturbing petitioner regular life and without following proper procedure simply calling him to police station mulugu and threatening him for arrange the extra amount to respondent No4 is illegal; arbitrary and violative of Article 14 and 21 of constitution of India and direct the respondents follow the proper procedure and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case."

When the matter is called today, written instructions dated 03.09.2015, furnished by the Sub Inspector of Police, Mulugu Police Station, Medak District, have been placed on record by the learned Government Pleader for Home and the said instructions read as under: "It is submitted that as per the records, it is revealed that the 4th respondent herein lodged a complaint before the Police Station on 10.7.2015 against the petitioner. Upon which an entry was made into the Station General Diary and to know the veracity in the contents of the complaint, made a call over phone to the petitioner but did not lifted the phone, then the respondent police sent a SMS message to the petitioner for enquiry purpose.
It is submitted that the petitioner came to the police station Mulugu on 21.7.2015 during the enquiry it is revealed that there is a civil dispute between the petitioner and the 4th respondent and hence this respondent advised the complainant respondent to seek his redressal in a competent civil court.
It is submitted that the allegation of the petitioner that the 4th respondent utilizing the mulugu police and
threatening him with dire consequences and the police of Mulugu without registering any case against him, threatening him and directing him to arrange the extra amount to the 4th respondent herein and that the police simply calling him every day and harassing him over phone and disturbing his regular life without registering any case is absolutely false, baseless and hence denied.
It is pertinent to submit that having bore grudge against the 4th respondent herein the petitioner made baseless allegations against this respondent police which are far from truth.
It is humbly submitted that as a precautionary measure to prevent the police from taking any action in the event of lodging of any complaint the petitioner rushed to this Hon'ble Court and filed the present writ petition on mere apprehension."
3. On noticing the said written instructions, learned counsel for the petitioner requested this court to dispose of the writ petition by recording the said written instructions.
4. In view of the above, writ petition stands disposed of, by recording the written instructions dated 03.09.2015, furnished by the Sub Inspector of Police, Mulugu Police Station, Medak District.
