HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.24623 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the action of the third respondent in issuing the provisional assessment notice in Lr.No.ADE/O/KDR/D.No.859/16 dated 01.05.2016 in Case No.DPE/RJPT/KODRO/2876/16 assessed at Rs.43,695/- to the petitioner's service connection in S.C.No.2333419000210 category LT1 (A) Domestic, Mangalampalli village, Obulavaripalli Mandal, Kadapa District, despite the petitioner has been regularly paying the consumption charges as wholly arbitrary and illegal and consequently set aside the provisional assessment notice dated 01.05.2016.

Heard the learned counsel for the petitioner and Smt. Jagarlamudi Koteswari Devi, learned Standing counsel for the respondents.

At the time of arguments, learned counsel for the respondents submitted that the respondents have no objection to restore the power supply if the petitioner pays 50% of the assessment.

Learned counsel for the petitioner submitted that the petitioner has already paid an amount of Rs.11,000/-. In view of the submissions made by both the counsels, the third respondent is hereby directed to restore the service connection of the petitioner bearing S.C.No.2333419000210 Category LTi(A) Domestic, Mangalampalli village, Obulavaripalli

Mandal, Kadapa District, on condition of the petitioner depositing a further sum of Rs.10,000/-, besides the payment of Rs.11,000/- already made by him.

With the above direction, the writ petition is disposed of. As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
