HON'BLE SMT. JUSTICE JUVVADI SRIDEVI CRIMINAL PETITION No.12727 of 2024 ORDER :

Petitioners/accused Nos.2 and 3 have filed this petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking anticipatory bail in Crime No.313 of 2024 of Matwada Police Station, Warangal District registered for the offences punishable under Sections 417, 420, 506 r/w 34 of Indian Penal Code.

Heard Sri S. Sudarshan, learned counsel for petitioners and Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing for the State and perused the record. 3.

The case of the prosecution is that A1 has entered into agreement of sale with the complainant for sale of property and received advance of sale consideration and thereafter, registered the property in the name of A2 and A3, and thus, deceived him. 4.

Learned counsel for the petitioners/accused Nos.2 and 3 submits that the dispute is of civil nature and the property was

purchased by the accused in the year 2017 and after a long period of time, the present complaint is filed.

Though the learned Additional Public Prosecutor has opposed the application, since property in question was purchased by the petitioners in the year 2017 itself, prima facie, it cannot be said that the petitioners have cheated the complainant, this Court is of the considered opinion that it is a fit case for grant of anticipatory bail, subject to the following conditions:

1. The petitioners/accused Nos.2 and 3 shall surrender before the Station House Officer of Matwada Police Station, Warangal District, within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioners on bail on their executing a personal bond for Rs.20,000/- each with two sureties, for the like sum each.

2. The petitioners/accused Nos.2 and 3 shall appear before the concerned Station House Officer on every Saturday between 11.00 A.M. and 01.00 PM for a period of eight (08) weeks or till filing of charge sheet, whichever is earlier.

3. The petitioners/accused Nos.2 and 3 shall abide by the other conditions stipulated in Section 482

(2) Bharatiya Nagarik Suraksha Sanhitha, 2023 and co-operate with the Investigating Officer in investigating the case.

Petition is accordingly allowed.
