HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION NO.3241 OF 2015 ORDER:
The Writ Petition is filed questioning the inaction of the 1st respondent in not considering the representation dated 12.12.2014 to implement the order dated 04.06.2014 passed by him under the provisions of the A.P. Records of Rights in Land and Pattadar Pass Book Act, 1987 (in short "the Act") and the Rules made thereunder and also the failure on the part of the respondent Nos. 2 to 4 to consider the grievance of the petitioner under letter dated 25.12.2014.
The grievance of the petitioner is that petitioner had made application with regard to seeking issuance of pattadar passbooks by filing Form No.VI(A) on 16.05.2012. Thereafter on 04.06.2014, the Tahasildar issued endorsement holding that he would be entitled to pattadar passbook and title deeds over an extent of Ac.2-76 cents only with respect to survey Nos.417, 419, 463, 464/1, 554/1. Petitioner was also directed to submit certain supporting documents. Thereafter, petitioner had submitted the required documents and in fact once again submitted the same through his letter dated 12.12.2014. In spite of the same, the necessary entries in revenue records are not being made and pattadar passbooks are not being issued.
So far as the contentions made by the petitioner, are not denied except stating that petitioner is once again is requested to require to submit necessary documents through Mee Seva centre in Form No.VI (A). So far as the stand taken by the Tahasildar is totally unmeaning, inasmuch as the Tahasildar has already passed an order determining the entitlement of the petitioner by his order
dated 04.06.2014 and required the petitioner to submit certain documents. Now the Tahasildar has duty to bound to consider the same and implement the order dated 04.06.2014 to the extent petitioner is entitled to by issuance of pattadar passbooks and by making necessary entries in the revenue records. Accordingly, there shall be a direction to the 1st respondentTahasildar to take all further steps pursuant to the order dated 04.06.2014 passed by his office in Rc.B/140/2012, dated 04.06.2014, within a period of eight (08) weeks from the date of receipt of the copy of this order.
Writ Petition is disposed of accordingly. Miscellaneous petitions, if any pending, in this Writ Petition shall stand closed. ____________________________ CHALLA KODANDA RAM, J Dated:02.03.2015.
