PETITIONER AND The Joint Collector, (Civil Supplies Wing), Warangal District, Collectorate, Warangal.

RESPONDENT

ORDER:

This writ petition is filed seeking the following - "....to issue an appropriate writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondent authorities in seizing the stock of 10 KLs of 'Chemical Reducer' in connection with the case under Section 6A of the E.C. Act, on 02-02-2009 as illegal, arbitrary and without jurisdiction and consequently direct the respondent and his subordinates to release the said seized stock in favour of the petitioner forthwith......" This Court while issuing Rule Nisi on 24.02.2009 passed interim order directing the respondents to release the seized stock subject to condition of the petitioner furnishing bank guarantee for the value of the entire stock seized.

In as much as the seized stock has already been released, release of bank guarantee shall be subject to the result of the final orders that may be passed in the proceedings under Section 6A of the Essential Commodities Act, 1955.

It is submitted by the learned counsel for the petitioner that even Section 6A proceedings also culminated in final orders. In view of the said submission, nothing survives for adjudication in this writ petition as the writ petition itself is filed seeking a limited relief.

Accordingly, the writ petition is closed. As a sequel, pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
