THE HON'BLE SRI JUSTI CE SANJAY KUMAR CONTEMPT CASE No.1256 of 2016 ORDER:

This contempt case was instituted alleging willful disobedience to the order dated 21.03.2016 passed in W.P.No.9130 of 2016. By the said order, the Karimnagar Municipal Corporation, Karimnagar, was directed to take appropriate action upon the petitioner's representations in relation to the alleged unlawful construction made by the fourth respondent in the writ petition.

The Commissioner, Karimnagar Municipal Corporation, filed a counter-affidavit stating that the order was duly complied with. A copy of the order dated 11.07.2016 passed by him is placed on record and demonstrates that pursuant to the order passed in W.P.No.9130 of 2016, the Commissioner conducted an enquiry and the unofficial respondent in the writ petition produced sufficient material and documents in proof of his construction having been made in accordance with the permission granted by the municipal authorities.

No reply-affidavit was filed rebutting the aforestated counteraffidavit averments. 4.

In that view of the matter, this Court finds no proof of disobedience, much less wilful disobedience, to the order warranting exercise of contempt jurisdiction.
