THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.12309 of 2025 Seeking the Court to enlarge the petitioner who is arrayed as accused in FIR.No.379 of 2025 of Armoor Police Station, Nizamabad, on bail, the present Criminal Petition is filed.

The brief facts of the case are that, on 28.7.2025, the de-facto complainant lodged a report before the police stating that the accused used to give her tuition from 2017 to 2020 and he started following her under the pretext of love and marriage and she informed the same to her mother and however, he did not change his behavior and continuously followed her, misbehaved with her, and threatened her that if she did not agree to marry him, he would kill her mother and elder brothers. Later, he also threatened to morph and post her private photos, which were taken during tuition sessions, on social media, he blackmailed her and, till now, he has taken a total amount of Rs.2,00,000/- from her; he frequently visited her house and insisted her to marry him. 27.7.2025, while she was proceeding from her house to the bus stand on her scooty, he stopped her near Ambedkar Chourastha, close to Balaji Sweet Home, forcibly caught hold of her hand, and tried to take her with him to marry her against her will, then her uncle, came there and rescued her, then she returned to her house and informed her family. Hence, she requested to take necessary action against the accused. Based on the said complaint, the Police registered FIR No.379 of 2025 for the alleged offences under Sections 75 (2), 77, 78 (2), 79, 351(3), 126(2) and 292 of BNS.

Heard Sri L. Ravi Chander, learned Senior counsel representing Sri Srinivas Bobbili, learned counsel appearing on behalf of the petitioner as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor for respondent-State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the alleged offences and the petitioner herein is in jail from 08.08.2025 and the defacto complainant herself was showing the photographs.

It is further submitted that the material part of the investigation was already completed. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations leveled against the petitioner are serious in nature. It is further submitted that the petitioner herein threatened the de-facto complainant that he will post her photographs in social media and also he backmailed her and took Rs.2,00,000/- from her. Further, the investigation is not yet completed. Therefore, he prayed the Court to dismiss the criminal petition.

In light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner herein is in jail from 08.08.2025. Further, LWs 1 to 8 witnesses were already examined. Considering the facts and circumstances of the case, the nature of the allegations,

the stage of investigation, and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions. i.

The petitioner/accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned Judicial First Class Magistrate, at Armoor.

ii.

The petitioner/accused shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner/ accused shall abide by the conditions stipulated in

Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
