ORDER
This petition is filed under Section 482 Cr.P.C., to quash the proceedings in Crime No.110 of 2017 of Mandamarri Police Station, registered for the offences punishable under Sections 120b, 447, 427, 468, 342 read with 149 IPC and Section 3(i)(f)(q) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 2015 (for short 'the Act'), on various grounds.
The petitioner is Sub Inspector of Police, Vavialapalli Police Station, Karimnagar District and accused in the above crime. It is the case of the petitioner that he registered Crime Nos.30 and 31 of 2017 of Mandamarri Police Station against the 2nd respondent for the offences under Sections 447, 420, 467, 468, 506 read with 149 IPC respectively and that the petitioner registered the above crimes while discharging his duties only. The registration of crime against the petitioner, who is Sub Inspector of Police is without following the guidelines issued by the Apex Court in Dr. Subhash Kashinath Mahajan v State of Maharashtra and another1, which is clear illegality. In view of the guidelines issued by the Apex Court in Dr Subhash Kashinath Mahajan's case referred supra, the Investigating Officer is directed to follow the said guidelines.
With the above direction, the criminal petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
