The Writ Petition is filed by the petitioner with the following relief : " to declare the action of respondents for not taking any action against the complaints made by the petitioner before respondent No.5/ Station House Officer, Subedari eventhough the appeal made before Respondent No.1 as illegal and arbitrary "
Learned Assistant Government Pleader for Home, on written instructions, submits that they have not received any complaint from the petitioner and even in the application filed by the petitioner under Right to Information Act, they have also stated the same thing. In the absence of receipt of any complaint from the petitioner, the respondent police are unable to take any action and whenever they receive complaint from the petitioner, they will take necessary action.
Recording the said submission, this Writ Petition is disposed. However, the petitioner is still aggrieved, he shall make a complaint before police and on receipt of the complaint, the respondent Police shall take action in accordance with law.
The miscellaneous petition, if any, in this Writ Petition, shall stand closed.
