P.Balaji .. Petitioner and The Tahsildar, Ibrahimpatnam .. Respondent Counsel for the petitioner: Mr.M.M.M.Srinivasa Rao, for Mr.Kowturu Vinayakumar Counsel for the respondent: Assistant Government Pleader for Civil Supplies (AP) The Court made the following:
ORDER:
This writ petition is filed with the grievance that without passing any order of suspension, the respondent withheld the essential commodities though the petitioner's fair price shop authorization was subsisting.
This Court, by order, dated 26.02.2009, in W.P.M.P.No.4998 of 2009, granted interim direction to the respondent to release the monthly quota of essential commodities to the petitioner, provided his fair price shop authorization was neither suspended nor cancelled as on that date.
At the hearing, Mr.M.M.M.Srinivasa Rao, learned counsel representing Mr.Kowturu Vinayakumar, learned counsel for the petitioner, submitted that in view of the aforementioned interim order, no further adjudication of the writ petition is necessary. The learned Assistant Government Pleader for Civil Supplies (AP), however, submitted that during the pendency of the writ petition, the petitioner has resigned his dealership and joined the Government service. In the light of the above facts, as no adjudication on merits of the Writ Petition is necessary, the same is disposed of by placing on record, the aforementioned submissions of the learned counsel for both the parties.
