HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 24136 of 2015 Order:

The petitioner was appointed as a Hindi Pandit Trainee on contract basis for the year 2009-10 and was posted at KGB Vidyalayam (Kasturi Ba Gandhi Balikala Vidyalayam) at Bandi Atmakuru of Kurnool District. She continued to work as such up to 2012-13. She was transferred to the fourth respondent School during the academic year 2013-14. She claims that while she was working as Hindi Pandit in the fourth respondent school, the third respondent issued a memo on 27.07.2015 engaging the fifth respondent in her place at the fourth respondent school. Challenging the same, the present Writ Petition was filed.

2. The petitioner states that she is competent person to teach Hindi subject and she has been discharging her duties without any complaint. She rendered seven (7) years of service as Hindi Pandit and in view of her age she is ineligible for any Government employment.

3. A perusal of the impugned memo dated 27.07.2015 shows that the fifth respondent was appointed for the academic year 2015-16 and the said academic year has already come to an end. Admittedly, the petitioner was appointed on a contractual basis initially for the academic year 2009-10, but was continued till 2014-15. The petitioner cannot claim any right for continuation solely on the basis of her continuance till 2014-15. The petitioner could not show any service rule or law entitling her to be continued in service. This Court sees no ground to interfere with the impugned memo.

4. The Writ Petition is, accordingly, dismissed at the admission stage. There shall be no order as to costs.

5. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition shall stand closed. ________________________ A.
