HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN Civil Revision Petition Nos.3239 and 3321 of 2016 COMMON ORDER:

These Civil Revision Petitions arise out of the orders passed by the trial Court allowing the applications for reopening the case and recalling DW.1 for further cross-examination.

2. Heard the learned counsel on both sides.

3. The suit is for partition. The suit is now pending for the past 17 years. The reason for the pendency for such a long time is the repeated filing of applications for impleadment and now applications for reopening and recalling. The respondents 1 and 2 in these revisions were the plaintiffs in the suit. The 1st respondent was the widow and the 2nd respondent was the daughter of one Venkata Rama Rao, through whom they claim a right to partition. The 1st defendant in the suit was the father-in-law.

4. It appears that the 1st respondent's husband died at a young age leaving the respondents 1 and 2 in the lurch. Therefore, it appears that she is collecting materials in support of her case. In such circumstances, the Court has done over all justice in allowing the applications and I do not want to interfere with the same. Hence, the Civil Revision Petitions are dismissed.
