Adavalli Uma, v. The District Collector,
THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.8455 OF 2005 DATED: 06.04.2015 Between:
Adavalli Uma and another .. Petitioners And The District Collector, Karimnagar and others .. Respondents THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.8455 of 2005 ORDER:
This writ petition was filed by two villagers of Gopalaraopet Village, Ramadugu Mandal, Karimnagar District, assailing the proposal of the authorities to dig a bore-well in Sy.Nos.131/2 or 132 of the village, claiming that they were the exclusive owners and possessors of the said lands. The Mandal Revenue Officer, Ramadugu, Karimnagar District, filed a counter admitting that the lands in Sy.Nos.131/2 and 132 of Gopalaraopet Village to the extent of 0.30 guntas were private patta lands recorded in the name of the 1st petitioner and that the Government had no right or title thereto. He further stated that though there was a proposal to dig a well in Sy.No.131/1 of the Village, which was Government land, the same was withdrawn because of the objection raised by the Deputy Executive Engineer, Sri Ram Sagar Project. He concluded by stating that
the authorities had no intention of digging a well or bore-well in the lands of the petitioners in Sy.Nos.131/2 and 132 of Gopalaraopet Village. In the light of the clear and unequivocal stand of the respondent authorities, it is manifest that the petitioners approached this Court on a mere apprehension. The stand of the authorities is taken on record.
The writ petition is accordingly closed.
Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
