In the present writ petition, challenge is to the letter bearing Rc.No.001/Audit-DCCB/Warangal/17 dated 24.3.2017 addressed by the Commissioner for Cooperation and Registrar of Cooperative Societies, State of Telangana, Hyderabad, directing the Chief Executive Officer, District Cooperative Central Bank, Warangal to furnish certain documents as indicated therein.

According to the learned Senior Counsel Sri D.Prakash Reddy, appearing for the petitioner, the very action of the Commissioner for Cooperation and Registrar of Cooperative Societies, State of Telangana, Hyderabad-3rd respondent herein in calling for the information covered by the impugned letter has no legal sanctity.

On the other hand, the learned Special Government Pleader Sri S.Sarath, appearing for the State contends that the said letter is only an internal correspondence between the office of the 3rd respondent and the Chief Executive Officer, District Cooperative Central Bank and the petitioner herein has absolutely nothing to do with the same and he is not an aggrieved party. It is also submitted by the learned Government Pleader that the power of the Registrar is traceable to Section 4 of the Telangana State Cooperative Societies Act. Learned Government Pleader also disputes the very maintainability of the writ petition, by contending that the bye-laws of the District Cooperative Central Bank authorise only the Chief Executive Officer to file the cases. Learned Government Pleader further contended that the records seized by the authorities for verification have already returned to the

District Cooperative Central bank, Warangal and there is also no need to get the information covered by the impugned letter for the present. It is further submitted that the Respondents herein will initiate action, if necessary, strictly in accordance with the provisions law. 4.

Learned Senior Counsel appearing for the petitioners also submits that the Respondents are required to adhere to the provisions of Telangana State Cooperative Societies Act and the Rules made thereunder, if any action is proposed.

In view of the above developments and taking into consideration the submissions of the learned Senior Counsel, appearing for the petitioners and the learned Special Government Pleader, appearing for the State, the writ petition is accordingly closed.
