HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.10461 OF 2017 ORDER:

This writ petition is filed seeking writ of mandamus declaring the inaction of the 3rd respondent in not mutating and not issuing patta pass book and title deed to the petitioner to an extent of Acs.1.34 guntas in Sy.No.1011 and Ac.0.06 guntas in Sy.No.1010 totaling to an extent of Ac.2.00 guntas, situated at Ameenpur Village, Patancheru Mandal, Medak District despite order dated 29.06.2016 in WP No.27365/2011 and representations dated 16.08.2016 and 01.11.2016 of the petitioner as illegal and arbitrary and consequently to direct the 3rd respondent to comply with the above order of this Court. It is the case of the petitioner that she made an application for mutating her name in revenue records and also for issuance of pattadar pass books and title deeds in pursuance of the partition decree in O.S.No.219 of 1982, dated 02.07.1994.

In pursuant to the same enquiry was conducted by the Tahsildar-3rd respondent, who in turn addressed letter No.B/2121/2010, dated 13.11.2015 to the District Collector-2nd respondent seeking permission to implement the decree in the aforesaid suit. But as on today, no action is being taken. Aggrieved by the same, present writ petition is filed.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

Learned counsel for the petitioner submits that one of the parties to the partition decree filed W.P.No.27365 of 2011, which was disposed of by this Court vide order dated 29.06.2016, directing the 2nd respondent to take action for mutating the name of the petitioner therein.

Following the same, the 2nd respondent is directed to take further action in pursuant to letter dated 13.11.2015 addressed by 3rd respondent keeping in view order dated 29.06.2016 in WP No.27365 of 2011 for mutating the name of the petitioner's name in revenue records, within a period of two months from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. Office to annex copy of order dated 29.06.2016 in WP No.27365 of 2011.
