HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.23268 of 2016 ORDER:

The writ petition is filed against the order dated 09-05-2016 in Proceedings D.Dis.A/2304/2015 passed by the Revenue Divisional Officer (R.D.O.), Markapur, whereby the R.D.O. cancelled the pattadar passbooks at the instance of unofficial respondent and directed the Tahsildar to grant pattadar passbook and title deed to unofficial respondent. On that the petitioner filed revision before the 2nd respondent. Aggrieved by non-disposal of revision, the present writ petition is filed.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

Learned counsel for the petitioner submits that the R.D.O. has no power to cancel the pattadar passbooks or title deeds by straightaway entertaining the applications, even otherwise, in view of judgment of Ratnamma v.Revenue Divisional Officer, Anathapur District[1]. Since it is stated that revision filed by the petitioner is pending before the 2nd respondent, the 2nd respondent is directed to dispose of the revision after issuing notice to both parties. Pending revision, there shall be interim suspension of impugned order dated 09-05-2016. Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
