HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.43398 OF 2016 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is preferred by the petitioners seeking to declare the action of the 4th respondent in proposing to lay the road in petitioners' lands in survey Nos.1037 and 1042 situated at B.Kothapeta Village and Mandal, Chittoor District, without any notice to the petitioners, as illegal and arbitrary.
Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue. With their consent, the Writ Petition is disposed of at the stage of admission itself. Learned AGP, on instructions, would submit that the authorities are not laying any road in survey Nos.1037 and 1042 of B.Kothapeta Village & Mandal, Chittoor District. As such, the question of directing the authorities to follow due process of law would not arise.
Recording the statement of the learned AGP, the Writ Petition is closed.
