THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN CONTEMPT CASE No.254 of 2014 ORDER:
Heard Sri K.Jagadishwar Reddy, learned counsel for the petitioner, and Sri G.Narender Reddy, learned Standing Counsel for Telangana Mandal Praja Parishad & Gram Panchayat Praja Parishad.
The order, violation of which is alleged in this Contempt Case, is the order passed by this Court in W.P.No.613 of 2014 dated 07.02.2014 wherein this Court observed that, if the petitioners present the cheques, handed over across the bar to the learned counsel for the petitioners, within one week from the date of the order and, in case the cheques are so presented, the respondent should not take any coercive steps to evict them till the cheques were realized, and for one week thereafter. It was made clear that, in case the petitioners did not present the cheques within the aforesaid period of one week, it was open to the respondents to take necessary action, for their eviction, in accordance with law.
A counter-affidavit is filed by the Panchayat Secretary stating that all the petitioners had deposited the cheques in the bank except for three petitioners, these three had deposited the cheques later and had withdrawn the deposited amount; and some of the petitioners had participated in the public auction and were allotted shops on their being found to be the highest bidder. It is evident, therefore, that the order, violation of which is alleged in this Contempt Case, has been complied with. I see no reason, therefore, to proceed against the respondents under the Contempt of Courts Act, 1971.
The Contempt Case is, accordingly, closed. Miscellaneous petitions pending, if any, shall also stand closed. There shall be no order as to costs.
