THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36130 of 2016 ORDER:

In this writ petition, the petitioner is seeking a writ of mandamus declaring the action of the 2nd respondent in not allowing to operate the petitioner's current account No.52100088011 with the 3rd respondentBank as arbitrary and illegal and consequently, direct the respondents 2 and 3 to permit the petitioner to operate the said current account. Today, when the matter is taken up for hearing, though several allegations are levelled in the writ petition, the learned counsel for the petitioner confined his arguments to the extent of giving liberty to the petitioner to approach the Court concerned by way of an application.

Considering the facts and circumstances of the case, without going into the merits of the case, the petitioner is directed to approach the Court concerned and file an application for de-freezing his current account with the 3rd respondent informing that he is not an accused in any case; that he is only a witness and also informing that he is ready to depose before the Court at the appropriate time as per the statement recorded by the 2nd respondent herein. On filing such an application, the Court concerned is directed to consider and dispose of the same in accordance with law within a period of 15 days from the date of filing of application by the petitioner.

With the above direction, the writ petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. _________________ RAJA ELANGO,J 05.12.2016.
