THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.16718 OF 2011 ORDER:

Petitioner filed this writ petition seeking to issue a writ of mandamus declaring the action of the respondent-GHMC in interfering with the erection of tower by the petitioner-Company at H.No.22-89, Saraswathi Nagar, Road No.3, Dilsuknagar, Hyderabad, by virtue of deemed permission, without issuing any notice whatsoever and without following due process of law as being illegal, arbitrary and for issuance of appropriate consequential directions.

2. This Court by order dated 17-06-2011, while issuing rule nisi, granted interim direction to the respondent not to interfere with the erection of the tower by the petitioner-Company in the said premises. No counter affidavit is filed by the respondent.

3. Inasmuch as the relief sought in the writ petition is worked out by way of the interim direction granted by this Court, no further orders need be passed in this writ petition. Hence, the writ petition is disposed of making the interim order as final order in the writ petition. However, it is open for the respondent to take appropriate action, if the petitioner violates any provision of law, by following due process of law. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. No order as to costs. _________________________ A.RAJASHEKER REDDY, J
