THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.15025 of 2015 ORDER:

Challenging the proceedings dated 22.05.2015 issued by the 2nd respondent suspending the authorisation of the petitioner, the present writ petition is filed. Initially the authorisation of the petitioner was suspended by the 3rd respondent holding that the petitioner committed certain irregularities in distribution of essential commodities to the card holders. Aggrieved by the same, the petitioner filed an appeal before the 2nd respondent-Joint Collector. Under the order impugned, the appellate authority dismissed the said appeal confirming the order of the 3rd respondent, however, directing him to dispose of the matter finally within a period of six weeks, after affording an opportunity of hearing to the petitioner. I do not see any error in the said order of the 2nd respondent.

The learned counsel for the petitioner raised various contentions challenging the suspension pending enquiry passed against the petitioner. However, it is well settled that the order of suspension pending enquiry cannot be interfered with unless there is any mala fides in the said order. I see no reason to interfere with the order of the 3rd respondent. However the 3rd respondent is directed to implement the appellate authority's order in the letter and spirit and take appropriate decision in accordance with law expeditiously. Accordingly, the writ petition is dismissed. No costs. As a sequel, miscellaneous petitions, if any, shall stand closed. __________________________ VILAS V.
