HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION NO. 25617 OF 2017 ORDER:

The document PNo.108/2017 presented by the petitioner was refused vide refusal No. 1/2017 dated 17.7.2016 on the ground assigned therein.

Against the decision of the Sub-Registrar refusing to register the document presented before him, under Section 72 of the Registration Act, appeal shall lie to District Registrar. Without availing the remedy of appeal, the present Writ petition is field. Section 72 vests substantive right of appeal in a person aggrieved by the decision of the Sub-Registrar refusing to admit a document for registration.

Since the valuable right is conferred on the Petitioner under Section 72 of the Act and petitioner failed to avail the said remedy, this Court is not inclined to entertain the Writ Petition. Accordingly, Writ Petition is dismissed leaving it open to petitioner to avail the remedy of appeal. It is made clear that all the contentions raised in the Writ Petition are left open to agitate before the concerned authority.
